TikTok Files Legal Challenge Against U.S. Divestiture Law Citing Free Speech Concerns

TikTok and its parent company, ByteDance, have filed a formal legal challenge in a U.S. federal court seeking to block a newly enacted law that could lead to a nationwide ban of the social media platform. The legislation, signed into law by President Joe Biden last month, mandates that ByteDance sell TikTok’s U.S. operations within nine months or face a total removal from domestic app stores. In the filing, the company argues that the mandate is unconstitutional and violates the First Amendment rights of its 170 million American users. Supporters of the law, including a bipartisan group of lawmakers and national security officials, contend the move is a necessary step to protect citizen data and mitigate risks of foreign influence. Legal analysts indicate the case may take months to resolve and could potentially reach the Supreme Court, setting a significant precedent for the intersection of national security and digital expression.
